Actually, you can file 485 when your PD becomes current, even if the 140 is still pending approval. You need to submit the 140 details alongwith your 484 application.

Can anyone tell when will EB3 India crossover to May 2001 from April 2001 without any new law.
let me try to guess this..mmm..tough question though, assuming they take 1 month to move one day..earliest would be in another 30 months..just kidding.. though i wont be surprised, even if it happens that way..no one know what is their freakin calculation to move these dates.

Well, my forms were returned to my attorney because of some filing issue. So instead of my EAD as I was expecting I have to refile. Of course I now have a job offer that I would like to take.
My husband (who is a US citizen) is in school and will be depending on my salary. I dont know if that counts as a big financial loss.
Where can I go to find this out. I think my attorney i doing a less than great job in giving me the proper options to choose from.
Any help would be appreciated.

RFE is very clear, basically they are asking the documents, which has Picture ID, where your name was mentioned as Pravin, PRaveenkumar and Pravinkumar.
I dont think u will be able to produce the picture Id for the birth certificate, but for the passport or any other state issued ID, you might be able to have some kind of picture Id dcument which bears your photo.
Please consult a good attorney who can deal with this situation, this is very unusual circumstances where you appeared to have 3 different names in 3 different doucments and the USCIS IO is confused on how to deal with this situation and requesting the evidence just to make sure that he is issuing GC to appropriate person.
I know in india it is possible to have these kind of mistakes, but unfortunately USCIS doesnt understand it. you have to have to good attorney to respond this RFE.

there is a wonderful app called "GOOGLE". That would help you
follow these steps:
Procedure A
1.) type www.google.com
2.) in the small box that appears, type cruise deals
3.) click enter
4.) in the results page that you may or may not get [depending on what crap u typed in step 2] open each page
for eachpage follow the below things
Procedure B
1.) click on page
2.) look for the deal you want
3.) if you find it, then book
4.) if you don't find, then click on back button
repeat the above [procedure B] until u get what u want
if u don't get anything from above steps then retry procedure A with a different keyword.

neither lawyer nor employer received Labor Hard Copy until today. I missed I-140 Premium
Processing because of Hard copy.
I signed one page of the original document (which the employer/lawyer should send to you)
before filing your I-140.

there is a little logic involved here. what if you changed the jobs between your AC21 and latest NOID. I think CIS just wants to make sure you are still hired by issuing a NOID even though they looked into AC21.
BTW I had the same situation and I had to respond to NOID with the same emp letter.

I am going to apply for i-485,
i have birth certificate which is taken in 2005 but I was born in 1974
some of my friends are saying...as you are born in 1974 and as your
birth certificate was taken in yr 2005, it might cause problems (ins poseses query)
to get the green card.
Is it right?
They are saying me to get Affidivits + non availability certificate now.
will it be a problem if I put my birth certificate....while applying for 485

Your friends are correct. U can avoid RFE in I-485 by using affidavits.

By the way, I got my FP notice for 23-Nov, a day after Thanks Giving. It looks like the original place for which I got the FP notice seem to open on that day. Is it true for all centers? What I mean to say is if a ASC is open in one region on a very likely holiday, the other ASCs would not be closed on the same day just because its a smaller center, will they?
Since all ASCs are federal offices, so dates of closure and holidays should be same through out, shouldn't it? Unlike the post offices, some are open on Saturdays and some are not....you see where I am going with this?

From what I understood his lawyer did not send the employment letter in the first place. His priority date is Sep 04 ROW, mine is July 04 ROW.

That's expected. The CIR contains highly controversial language there dealing with illegal aliens, which is clearly opposed by the majority of Americans. We are in the middle of it. That is it. It is silly expect otherwise. If you follow the results of last elections, you will see that there is a tendency that supporters of illegal alien legalization are losing.
