DAZED: Once your H1B extension is approved, it will expire only on the date shown in I797. Your 485 rejection does not invalidate your H1. BTW, if you use your H1, your H1 is invalid but you will still be able to extend it as long as it has not expired.

I have a EB2 labor that is approved from BEC. But i have already applied 140 and 485 using EB3 labor and both are pending. Now I am planning to interfile 485 once my old 140 approves.
My question is does my labor expire, If I dont use it to file 140.

Did anyone (or spouse) applied for Social Security No. who were using ITIN before, for tax purposes. I have applied for 485 and EAD and plan to apply for my wife's Social Security once I get the EAD. Are there any tax filing implications? How to switch to this new number and still be able to e-file next year (assuming I get EAD this year)?

So how abt I-765 and I-131 forms which will be submitted with 485.
If I submit on August 5th, do I need to pay old fees or new fees for the I-765 and I-131 .
All other forms except i-485 the fee increase will be effective from july 30th and i-485 will get increased post August 17th:)

My wife met with a very minor accident and it was her first accident. It was an on a unattended car. The back bumper of the car got scratched, The main mistake she did was , she did not leave a note and she came home, she basically panicked. She called me and I told her to go back and call police by that time, somebody complained to police and police came home and issued citation. According to Florida statues this is a criminal violation.
The following is the detail of the citation.

Aggressive Driving - NO

I am in the process of talking to traffic violations related and Immigration attorney.
I would appreciate if somebody can please advice on the following.
1) What will happen to her I485 process? currently she has EAD and I485 is pending
2) She is unemployed currently but if she decides to work in the future will this cause any issues when employer does background check?
3) Attorney mentioned that he can clear the points and criminal violation records but will this still be a issue for I485 process?

What would be fee for the old folks who filed I-485 in June?

My EB3 140 approved with priority date 01June2002 --> Company A
My EB2 140 pending with priority date 10May2006 -->Company A (different title...future position)
Can i port my EB3 priority date (June 2002) to EB2 application & apply I-485?.If i do, will my EB3 140 gets invalid?.I will need to file 3 year H1B extn(in Oct) based on my approved EB3 application & don't want to loose my approved 140.

The portability of I-140 priority date should be done at the time the I-140 is filed. So when your EB-2 I-140 was filed, you should have requested it at that time. There is a column on the Form I-140 which asks if an I-140 was ever approved on behalf of the beneficiary.
Why don't your file your H-1B extension now using Premium Processing? It will be approved for 3 years in 10-15 days then then you can think about porting your EB-2 priority date to EB-3.

I came back to US from India vacation on 10-Sep-2007. My H1 Papers from Company-B got approved(on 5-Sep-2007) just before I start from India . So I could not show the new Company-B h1 papers at the Port of entry to the CBP officer. I got my new I-94 date based on the old Company-A H1 papers which is valid till 30-Sep-2007.
I red on the Immigration Forums that USCIS follows last action rule to determine the validity of I-94. In that scenario, the I-94 that comes with my new H1 paper gets invalidated. If it is true, am I out of status after 30-Sep-2007?
Could you please advice on my possible options on this issue?

2 Call the Internal Revenue Service at 1-800-829-1040 and file a W2 complaint. They wil take a report and send you a form that you can use as a subsitute, you will need your last paycheck stub when you call, along with the name, address and phone# of the employer and what dates you worked for them

Employer has the liability to send the W2 form by Jan 31st and they need to keep proof for that. When u complain IRS will ask to send the proof and fine them 300$.
After getting the notice even if company doesnt give the W2 form u can use the substitue form which will be mailed by IRS once u complain.
